Terms of Service for Hey Today

1. Agreement to Terms

By accessing or using Hey Today ("Service", "App", "we", "us", or "our") at app.heytoday.co, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Hey Today is a day planning application that helps you:

• Create and organize tasks by category
• Schedule tasks on a visual timeline
• Track task completion
• Integrate with Google Calendar (optional)
• Sync data across devices

The Service is provided free of charge during the beta period. We reserve the right to introduce paid features or subscriptions in the future.

3. User Accounts

Account Creation

To use Hey Today, you must:

• Be at least 13 years of age
• Provide a valid Google account for authentication
• Provide accurate and complete information
• Maintain the security of your account credentials

Account Security

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Using a strong, unique password for your Google account

We are not liable for any loss or damage arising from your failure to maintain account security.

Account Termination

We reserve the right to:

• Suspend or terminate accounts that violate these Terms
• Refuse service to anyone for any reason
• Delete inactive accounts after 12 months of inactivity (with prior notice)

4. Acceptable Use

You Agree To:

• Use the Service only for lawful purposes
• Respect the intellectual property rights of others
• Provide accurate information
• Use the Service in accordance with these Terms

You Agree NOT To:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service or servers
• Scrape, data mine, or harvest data from the Service without permission
• Use the Service to spam or send unsolicited communications
• Reverse engineer, decompile, or disassemble the Service
• Use automated tools (bots, scripts) to access the Service without permission
• Resell or redistribute the Service without authorization
• Impersonate another user or entity
• Upload or share illegal, offensive, or harmful content

Consequences

Violation of these terms may result in:

• Immediate suspension or termination of your account
• Legal action if necessary
• Reporting to appropriate authorities

5. Content Ownership and Rights

Your Content

You retain all rights to the content you create in Hey Today, including:

• Tasks and task descriptions
• Categories and category names
• Any other data you input

By using the Service, you grant us a limited license to:

• Store and display your content
• Backup your content for service continuity
• Use aggregated, anonymized data for analytics and improvements

This license terminates when you delete your content or account.

Our Content

The Service itself, including:

• Design, layout, and user interface
• Software code and algorithms
• Logos, trademarks, and branding
• Documentation and help materials

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Create derivative works based on the Service

6. Google Calendar Integration

Authorization

When you connect your Google Calendar:

• You authorize Hey Today to access your calendar data (read-only)
• You grant permission to cache calendar events for display purposes
• You can revoke this permission at any time

Scope of Access

We will:

• Only access your primary Google Calendar
• Only read calendar data (we do not write or modify)
• Hold events in browser memory only (not stored on our servers)

We will not:

• Modify, create, or delete events in your calendar
• Share your calendar data with third parties
• Store your calendar data on our servers (events exist in browser memory only)

Your Responsibilities

You are responsible for:

• Ensuring you have the right to connect calendars you don't own
• Understanding that shared calendars will display events from all contributors
• Revoking access if you lose access to the connected Google account

Disconnection

You may disconnect your Google Calendar at any time via:

• Hey Today Settings > Google Calendar > Disconnect
• Google Account Permissions page

Disconnection clears your calendar connection status. No persistent calendar data needs to be deleted since events are only held in browser memory.

7. Data and Privacy

Data Collection

We collect and process data as described in our Privacy Policy, which is incorporated into these Terms by reference.

Data Usage

By using the Service, you consent to:

• Data collection and processing as described in the Privacy Policy
• Storage of your data on third-party servers (Supabase)
• Transfer of data to the United States

Data Security

While we implement reasonable security measures:

• We cannot guarantee absolute security
• You use the Service at your own risk
• We are not liable for unauthorized access due to circumstances beyond our control

Data Backup

You are responsible for:

• Maintaining your own backups of important data
• Exporting data before account deletion

We perform regular backups but are not liable for data loss.

8. Service Availability

Uptime

We strive to maintain high availability, but:

• We do not guarantee uninterrupted access
• The Service may be unavailable due to maintenance, updates, or outages
• We are not liable for damages resulting from service interruptions

Maintenance

We may:

• Perform scheduled or emergency maintenance
• Temporarily suspend the Service for updates
• Make changes to the Service without notice

We will attempt to notify users of planned maintenance when possible.

Beta Status

Hey Today is currently in beta, which means:

• Features may change or be removed without notice
• Bugs and issues may occur
• The Service is provided "as is"

9. Modifications to Service

We reserve the right to:

• Add, modify, or remove features
• Change pricing or introduce paid tiers
• Update these Terms at any time
• Discontinue the Service with reasonable notice

Notification of Changes

• Notify users via email or in-app notice

Continued use of the Service after changes constitutes acceptance of new Terms.

• Supabase: Subject to Supabase's Terms
• Posthog: Subject to Posthog's Terms

Your use of third-party services is subject to their respective terms and policies.

No Endorsement

Links to third-party websites or services do not constitute endorsement. We are not responsible for:

• Third-party content or services
• Changes to third-party terms or policies
• Issues arising from third-party integrations

11. Intellectual Property

Copyright

All content and materials on Hey Today, including but not limited to:

• Text, graphics, logos, icons
• Software, code, and algorithms
• Design and compilation

Limitation of Liability

Our total liability shall not exceed the amount you paid for the Service in the past 12 months (currently $0 for free beta users).

13. Indemnification

Effect of Termination

Upon termination:

• We may delete your data after 30 days
• Sections of these Terms that should survive (indemnification, limitations of liability) remain in effect

16. General Provisions

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hey Today regarding the Service.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

Waiver

Failure to enforce any provision does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer these Terms or your account. We may assign these Terms to any successor or affiliate.

Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control, including:

• Natural disasters
• War or terrorism
• Government actions
• Internet or telecommunications failures
• Third-party service outages

Headings

Section headings are for convenience only and do not affect interpretation.

Language

These Terms are written in English. Any translations are for convenience only. The English version controls in case of conflict.

17. Beta Program Terms

Beta Status

Hey Today is currently in beta testing, which means:

• Features are experimental and subject to change
• The Service may contain bugs or errors
• We may collect additional feedback and usage data
• Access may be limited or revoked

Feedback

By using the beta:

• You agree to provide feedback upon request
• You grant us a license to use your feedback without compensation

No Service Level Agreement

During beta:

Transition to General Availability
